User Agreement

Please read this User Agreement before using Services.

USER AGREEMENT

ARTICLE 1- PARTIES

 

This User Agreement is made between “BİTA Teknoloji A.Ş” and the ‘User’ that signs up in the site, in order to determine the mutual rights and liabilities while using the services offered on the site at the time of signing up.

 

Both parties will be collectively referred to as the "Parties".

 

ARTICLE 2- SUBJECT OF THE AGREEMENT

The subject of the agreement is to determine the terms of use of the www.bitavita.com website and the mutual rights and liabilities of the parties.

 

ARTICLE 3- DEFINITIONS

Annexes to the Agreement: mean the texts of 

 

which constitute the annexes and integral parts of this Agreement. The said texts constitute a whole with this agreement, and the violation of the principles contained in these texts is equivalent to the violation of this agreement.

Bitavita: The company titled BİTA Teknoloji A.Ş., the operator of the site, means an independent private law legal entity established in accordance with Turkish Law.

 

User/Users: means the natural persons and legal entities that accept this agreement and sign up on the site.

Site: means the website consisting of the domain name www.bitavita.com and the subdomains connected to this domain name.

Cryptocurrency: Digital assets that allow cryptographic/encrypted secure transactions and additional virtual money supply are called cryptocurrency. Cryptocurrencies are alternative currencies, digital and also virtual currencies. Unlike centralized electronic money and banking systems, cryptocurrencies are decentralized. The control of this decentralized structure is carried out by Blockchain transaction databases. It is accepted by Bitavita that users know and understand the features of cryptocurrencies.

 

Cryptocurrency Wallets: These are unique and non-repeatable virtual wallet addresses that users can define to their accounts. It is a computer file that holds your Bitcoin

addresses and their passwords. Bitcoin is transferred between addresses. Bitcoin addresses are randomly generated cryptographic public key pairs. Public addresses are series that start with "1" or "3" created using approximately 33 letters and numbers.

 

ARTICLE 4- RIGHTS AND LIABILITIES OF THE PARTIES

 

  1. Membership:

The owner of all services, domain names, software codes, interfaces, contents, product reviews, videos, algorithms, drawings, models, designs and all other intellectual and industrial rights connected to Bitavita service (excluding content and applications provided from third parties) is Bita Teknoloji Anonim Şirketi. The software, design and copyrights of the services offered are fully owned by Bitavita. It is not allowed to copy, reproduce and disseminate the services and the pages linked to it, and to subject them to reverse engineering.

 

The legal and penal responsibility for every transaction and action made by the Users using the services received on the Site belongs to them. Bitavita has no legal or administrative responsibility.

The user is deemed to have read, understood and accepted the terms and conditions of this Agreement and its annexes, from the moment he/she opens an account to use the services offered by Bitavita www.bitavita.com with web applications, Bitavita mobile applications or APIs.

There are certain risks of investing in cryptocurrencies. By accepting and approving this agreement, users declare and undertake that they understand the risks of investing in cryptocurrencies and that they will not hold Bitavita responsible for any damages and losses that are caused or may be caused by the investment. Users are responsible for profits and losses resulting from price changes. Users agree and undertake that they will not claim any rights from Bitavita in case of loss or damage.

 

All users are required to completely fill in all the information in the form at bitavita.com/Login/register, accept this Agreement and provide all necessary documents and upload them to the Site in order to use the Site. Users must be of legal age (over 18 years of age) and have the capacity to act in accordance with the Republic of Turkey laws. The criteria of 18 years of age is determined according to the Central Population Administration System of the Republic of Turkey. Bitavita has the right to terminate/suspend User accounts, which, for any reason, it determines that the owner is under the age of 18 or suspects that they are used by persons under the age of 18, without notice. The User, that undertakes to be over the age of 18, is ex officio responsible for the accuracy of all the information he/she provides. It is not allowed to use the accounts of other members and/or to make transactions with these accounts.

 

As a result of fulfilling these conditions, the user account is approved by Bitavita and the User can benefit from the content, products and services offered on the Site. While benefiting from this content, products and services, the user has to follow any information, documents and announcements published on the Site, as well as e-mails and messages sent to him/her. This constitute a notification and the User accepts these issues in advance with this Agreement.
