CLARIFICATION TEXT

As BİTA TEKNOLOJİ ANONİM ŞİRKETİ (“Bitavita” or “Company”), we attach great importance to ensuring the security of all your personal data that you have transmitted to us, while using our website, by filling out the relevant application forms, or by other means, within the framework of the relevant legislation, especially the Law No. 6698 on Protection of Personal Data (“KVKK”). According to Article 20 of the Constitution of the Republic of Turkey, all natural persons have the right to demand the protection of their personal data. Within the scope of the protection of personal data, which is a constitutional right, our “company” takes the necessary administrative and technical measures to protect the personal data processed in accordance with the relevant legislation. We would like to enlighten you as Data Controller within the scope of the aforementioned legislation.

Your personal data that you share with our Company regarding all the activities you perform on our website within the scope of theUser Agreement may be processed, recorded, stored, maintained for certain, clear and legitimate purposes according to KVKK, within the framework of the KVK Policy , as prescribed by the law and honesty rule, in connection with, limited to and to the extent of the purposes of processing, accurately and currently; may be transferred to business partners, suppliers, subcontractors, performance assistants, relevant supervisory authorities, official institutions, and relevant third parties (natural persons/legal entities) at home and abroad; may be stored, updated, periodically controlled and classified here. If you give Commercial Electronic Communication Approval, our Company, as a data processor, may send you marketing and promotional e-mails and/or SMS, make phone calls, contact you via other communication channels you allow, or perform such services through third parties.

Your personal data may be stored, processed by our Company as data controller to make the membership transactions, to resolve your problems and complaints, to send the news, information and updates about our services, offers and other marketing elements related to special events and that may be of interest to you, if you have given your consent for commercial electronic messages, to understand the needs of our users, to respond to their requests faster and to improve our communication with our users and provide better service, to inform you about our products and services, to receive your opinions on our products and services, to develop and diversify our products and services in line with your requests and needs, and to carry out the necessary quality and standard audits as stipulated by the relevant legislations or to fulfill our reporting and other obligations stipulated within the scope of the relevant legislation. This service can be obtained from third parties.

Pursuant to Article 11 of the KVK Law, you can apply to our company and make requests regarding your personal data regarding the following issues:

• a) To learn whether personal data is processed or not,,
• b) If personal data has been processed, to request information about it,
• c) To learn the purpose of processing personal data and whether it is used in accordance with its purpose,
• ç) To know the third parties to whom personal data is transferred at home or abroad,
• d) To request correction of personal data in case of incomplete or incorrect processing,
• e) To request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7,
• f) To request that the transactions made pursuant to subparagraphs (d) and (e) be notified to third parties to whom personal data is transferred,
• g) To object to the emergence of a result against the person himself/herself by analyzing the processed data exclusively through automated systems,
• ğ) To request the compensation of the damage in the event that personal data is damaged due to unlawful processing.

The data subject undertakes that the personal data which is the subject of this clarification text is complete, accurate and up-to-date. In case of any change regarding the personal data, he/she can request the update of his/her personal data by informing the company. Our company will have no responsibility if the data subject has not provided correct and up-to-date information.

Pursuant to the KVKK, you are required to submit your request to exercise the rights above to our Company in writing. You can send your request to exercise your above-mentioned rights, which includes the necessary identification information and your explanations regarding the right which you request to exercise from the rights specified in Article 11 of the KVKK, to [email protected][email protected] . You can learn all other rights from our Company's KVK Policy . You can forward all your information requests to our company at [email protected] within the scope of the relevant law. You can access the relevant Application Form from the link or from the areas specified in the site. Your applications will be finalized within 30 (thirty) days at the latest, in line with the periods specified in the Law, after the verification of your identity by our Company.
